Privacy Policy

The BetterX Group are committed to protecting the privacy of its users and visitors in accordance with the provisions of the Privacy Act 1988 (Cth) and the National Privacy Principles which form part of that Act. This Privacy Policy (together with our Terms and Conditions) outlines our policies in relation to how BetterX collects, uses, maintains and discloses information relevant to its users and visitors. 

The BetterX Group includes the following entities:

collectively referred to as ‘BetterX’ throughout this policy.


Information collected

Where necessary, BetterX may collect personal information concerning users or visitors of its websites, social media sites, products or services. Personal information may also be collected from recordings of telephone conversations and publicly available registers. This information includes, but is not limited to: names, dates of birth, addresses, contact details, gender, occupation and employment details, personal assets and liabilities, tax file number and tax information, IP tracking data, passport or other government-issued identity document details, bank account details, credit card details, digital currency account data and order placement and transaction data.

Most of the Personal Information that we collect is obtained directly from our users through applications or other forms, and from maintaining records of information obtained in the course of providing our products and services. We may also obtain other information about you from third parties where you have provided your consent, to supplement the Personal Information we have obtained from you.  In the event of you not providing sufficient information required (or if you chose to use a pseudonym or remain anonymous) to fulfil your request for the provision of a product or service, we may be unable to provide you with the product or service that you requested.


Use and Disclosure of information collected

Personal information may be used by BetterX for various business-related purposes. These include, but are not limited to:

  • Executing and fulfilling your product and/or service order

  • Alerting you about new products, services, features or enhancements

  • Handling your customer support or technical support issues

  • Improvement of customer service

  • Processing payments

  • Fulfilling regulatory and compliance-related requirements

  • Outsourcing services incidental to the provision of the primary service.

BetterX may disclose personal information to third parties under circumstances relevant to the commercial relationship between BetterX and its users and visitors. These third parties include, but are not limited to:

  • Service providers who assist BetterX with client identification, due diligence, compliance, marketing and technology services.

  • Financial institutions and payment processors.

  • Anyone, to whom you have provided BetterX consent to do so.

  • Government authorities and law enforcement departments where BetterX are compelled to do so by a subpoena, court order or other legal process or where BetterX believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of our User Agreement.

  • Other entities in the event of a corporate sale, merger, reorganization, dissolution or similar event.

These disclosures may involve overseas storage and other overseas transfer, processing and use of your Personal Information. Further, your data may be disclosed by us to associated firms and vendors which conduct operational, technology and customer service functions in the USA, Australia, Singapore, Thailand, Ireland, Germany and other jurisdictions. These jurisdictions may not offer the same level of protection of personal information as may be enjoyed in your country of residence.


Consent to use and disclose

By providing any personal information to BetterX or by using the BetterX website and its associated services, all users and visitors fully understand and freely consent to the collection, use and disclosure of such information.


Storage and security of information collected

BetterX stores all personal information collected in secure computer storage facilities, paper-based files and other records, and takes steps to protect your personal information that we hold from misuse, loss, unauthorized access, modification or disclosure. However, we give no guarantee that such misuse, loss, unauthorized access, modification or disclosure will not occur.

We may be required by law to maintain records for a significant period of time. However, when we consider information is no longer required or relevant and any legal obligations that may apply to the information held have been met, we will remove details that identify you or we will securely destroy the records.


Accessing and editing personal information

You are entitled to have access to any personal information relating to you that we hold, aside from a few exceptional circumstances provided by law (including the Privacy Act 1988 (Cth)). You are also entitled to edit and correct such information if the information is incomplete, inaccurate, irrelevant, out-of-date or misleading. Direct Marketing from BetterX

BetterX may directly communicate with you with regards to business updates, publicity, reports, changes to the organisation, offers you may find of interest and to introduce and offer new products and services. You have the option to opt-out of receiving any BetterX marketing materials, which is communicated via email. Web-browser cookies

BetterX may use ‘cookies’ to enhance users’ and visitors’ experiences. Cookies are small amounts of data generated by a website and saved by your web browser. Its purpose is to remember information about you. While cookies serve many functions, their most common purposes are to store login information and user preferences. When interacting with BetterX services, users and visitors may choose their web browser to refuse cookies, or to alert you when cookies are being used. Should you choose to do so, please note that some services provided may not function properly.


Third party websites

BetterX’s website may contain links to or from external websites which are not subject to this Privacy Policy. This Privacy policy is only applicable to the information collected by BetterX. BetterX does not control the content or links that appear on other websites and takes no responsibility for the practices employed by websites linked to or from BetterX’s website. Third-party websites and services may have their own privacy policies and customer service policies. Browsing and interacting with third-party websites is done so at the users’ own risk and is subject to the terms and policies of these websites. 


Complaints

Any concerns or queries regarding this Privacy Policy may be directed to Trading@betterx.io. Your complaint will be processed through our internal complaints resolution process. If we are unable to resolve your complaint to your satisfaction, you have the option of taking your complaint to the Office of the Australian Information Commissioner (OAIC), www.oaic.gov.au who may investigate your complaint further.


Changes to our Privacy Policy

This Privacy Policy may be revised from time to time, without notice to users. If BetterX chooses to change this Privacy Policy, it will post the revised statement on its website. Please note that BetterX’s use of personal information will be based on the most current form of this Privacy Policy as amended.
